OVERVIEW OF JORDAN COVE / PACIFIC CONNECTOR PERMITS

JORDAN COVE EXPORT PROJECT CUP’S  LNG Marine Terminal; LNG Storage and Liquefaction facility; Gas Processing Facility; Utility Corridor; and Fire and Safety Center.  Land Use permit ACU-14-31 / Appeal file AP15-02:  Jordan Cove requested in a letter dated November 2, 2015 that this application be withdrawn.  Coos County withdrew the application on November 3, 2015.

Current status – Withdrawn

Land Use permit HBCU-15-05 for LNG Marine Terminal; LNG Storage and Liquefaction facility; Gas Processing Facility; Utility Corridor; and Fire and Safety Center.  Testimony that was submitted can be reviewed by extending the [+] under file HBCU-15-05 at the following link: http://www.co.coos.or.us/Departments/Planning/2015Applications.aspx

Current status: Pending – Hearing Officer recommendation went before the Coos County BOC on August 16, 2016.  Final Order dated August 30, 2016, was appealed to the Oregon Land Use Board of Appeals (LUBA) by the Oregon Shores Conservation Coalition on September 20, 2016.  The Confederated Tribes of Coos, Lower Umpqua and Siuslaw Indians, John Clarke, Deb Evans, Ron Schaaf, Rogue Climate, Stacey McLaughlin and Jody McCaffree all filed to be Intervenor-Petitioners on the side of the Oregon Shores Conservation Coalition in the appeal (LUBA-2016-095).  Coos County requested additional time to prepare and file the record with the LUBA, which they finally did on November 7, 2016.  The record was contested by the Confederated Tribes, Oregon Shores and other Petitioners in the case.  The Record was settled on June 9, 2017 with Petitioners Briefs due on June 30, 2017.  Respondents Briefs due on August 11, 2017 with Oral Argument set for August 24, 2017. (NOTE:  Due to conflicts of interest this date is in the process of being changed.)

JORDAN COVE TRANSPACIFIC HWY WIDENING  We appealed Coos County Planning Administrative approval of ACU-15-21 (Appeal file No AP-15-03) and provided testimony on September 29th.  A hearing was held on October 9th at 1:30 p.m.in Coquille.  Testimony that was submitted can be reviewed by extending the [+] under file AP-15-03 at the following link: http://www.co.coos.or.us/Departments/Planning/2015Applications.aspx

Current status: Pending – Hearing Officer agreed with appellants.  Coos County Board of Commissioners have yet to deliberate on the matter.

JORDAN COVE SOUTH DUNES POWER PLANT  Final Proposed Order from the Oregon Dept of Energy came out on October 12, 2015 .  The Energy Facility Siting Council had tentatively approved the Draft Proposed Order at their meeting in Coos Bay on Aug 7, 2015, without considering many of the concerns and legitimate issues we had raised in comments.  Citizens had to file requests for Party Status by November 12, 2015 in order to participate in the contested case in this proceeding.

Current status: Dismissed –  The Contested Case proceeding was dismissed at the request of Jordan Cove who withdrew their power plant application on December 13, 2016. On December 14, 2016, Hearing Officer Peterson issued an Order that officially dismissed the Contested Case on the Jordan Cove South Dunes Power Plant without prejudice, thus ending the contested case that was underway for that project.

JORDAN COVE WORKER CAMP   On Sept 21, 2015, the NB Planning Commission continued the hearing of the JC Worker Camp permit file No.CUP-4-15.  The Planning Commission made their final Worker Camp permit decision and approval of their July 20th and Aug 17th meeting minutes at their meeting on Oct 5th. Citizens appealed that decision to the North Bend City Council on October 19, 2015.  (http://citizensagainstlng.com/wp/2015/10/26/32-citizens-file-appeal-of-jordan-cove-lng-worker-camp-permit/ )

Current status: Pending – North Bend Planning had zoning text changed to add a Hearing Officer for zoning and planning reviews.  Worker Camp Permit application was placed on hold at Jordan Cove’s request.

PACIFIC CONNECTOR EXTENSION PERMIT  On September 22nd the Coos County BOC approved Hearing Officer Stamp’s recommendation and permit extension for another year until April 2016 for Coos County File No. ACU-15-07 / AP-15-01.  On April 11, 2016, Coos County File No. ACU-16-003 was extended until February 25, 2017 and Coos County File No. ACU-16-013 until April 2, 2017.

On May 17, 2017 Coos County Planning approved an extension request from Pacific Connector under EXT-17-002 to extend the CUP issued under HBCU-13-04 for one year until Feb 25, 2018.  Deadline to appeal was June 1, 2017.

On May 18, 2017, Coos County Planning approved an extension request from Pacific Connector under EXT-17-005 to extend the CUP issued under HBCU-10-01, Final Order No. 10-01-045PL as amended on remand, File No. REM-11-01, Final Order 12-03-018PL and as modified under HBCU-13-02, Final Order No. 14-01-006PL.  Extension was granted until April 2, 2018.  Deadline to appeal was set for June 2, 2017.

Current status: Pending:
On June 2, 2017, Citizens Against LNG filed an appeal under appeal file No. AP-17-004 of the Final Decision on Pacific Connector under EXT-17-005   An appeal hearing was originally set for August 9, 2017 at 1:30 p.m. in Coquille and has now been changed to August 25, 2017 at 1:30 p.m.

AIR QUALITY DRAFT PERMIT FOR PACIFIC CONNECTOR
On March 17, 2016, 6 p.m., DEQ held a short informational meeting followed by a public hearing on the air quality draft permit for Pacific Connector at Malin Community Hall, 2307 Front Street in Malin, Ore.  Pacific Connector proposes to construct and operate a compressor station near Malin in Klamath County, Oregon. The compressor station will compress natural gas to move the gas through the proposed pipeline to the proposed Jordan Cove Energy Facility in Coos Bay.  The draft air quality permit proposes to regulate emissions from the compressor station including greenhouse gases, oxides of nitrogen, carbon monoxide, sulfur dioxide, volatile organic compounds and particulate matter.  Questions on the draft permit can be directed to  Paul DeVito at 541-298-7255, ext. 240.

The comment period for this action was extended to April 5, 2016.  The hearing remained as scheduled on Thursday, March 17, 2016 at the Malin Community Hall.  Information about the proposal is presented in the Public Notice.

The Coast Guard July 1, 2008, Water Suitability for the Jordan Cove project stated on page 1 that Coos Bay was not currently suitable, but could be made suitable for the type and frequency of LNG marine traffic associated with the proposed project.

Under the new time frame, DEQ had until Oct. 13, 2017 to complete its review of the application.

Current Status: Pending – Decision extended 90 days until May 9, 2016 and extended again on May 4th to June 10, 2016.  Decision was extended once again until Nov 2016.  The November 10, 2016 deadline for the permit decision was extended by DSL to August 7, 2017.  The DSL notice stated the following:

The Jordan Cove project proponent, Veresen, requested an additional four months to complete an analysis of alternative designs for the Pacific Connector Gas Pipeline crossing at Haynes Inlet in Coos County.

The pipeline design, as proposed in permit application 54484-RF, would result in fill occurring in a portion of the Haynes Inlet estuary. Oregon law (ORS 196.8925) and administrative rule (OAR 141-085-0565(6)) require that removal-fill permits in estuaries must be for projects that are “for a public use” and that “outweigh harm to navigation, fisheries and recreation.” 

In agreeing to the four-month extension, the Department of State Lands proposed an additional five months for reviewing the new application materials (30 days); conducting an additional public comment period (30 days); time to review public comments (30 days); a 30-day contingency; and 30 days to finalize a decision.

Army Corps of Engineers – Removal-Fill 404 permit

Current status: Withdrawn –  On July 29, 2016, at Jordan Cove’s request, the Army Corps suspended their review of Jordan Cove’s Removal-Fill permit application.  The Corps may resume their evaluation after 6 months depending on whether or not FERC has issued its final Certificate-related decision.  After which the Corps may, at its discretion, deny the application without prejudice.

REM-11-01 (Final Order 12-03-018PL), which will remain in effect and as modified by File No. HBCU-13-02 (Final Order No. 14-01-006PL) until April 2, 2017 for the Pacific Connector Gas Pipeline land use permit in Coos County. [Coos County Administrative decision was issued on April 11, 2016 and became final on April 26, 2016]
      1. (AM-16-01)  Coos County Planning Text Amendments to CCZLDO / Hazard maps.  Coos Planning Commission held Hearings and Continued Hearings on July 7, 2016 and July 14, 2016.  The Coos County Commission held Hearings on: Aug 16, 2016; Sept 7, 2016; Oct 19, 2016; and Dec 7, 2015.  Proposed changes benefit the Jordan Cove project due to specific language and hazard mapping “not” being adopted that would bring the Ordinance in line with Oregon Statewide Planning Goals and certain hazard maps that are known to exist for Coos County, as established by the Oregon Geologic Compilation Database (OGDC) published by the Oregon Department of Geology and Mineral Industries (DOGAMI).  Other State and Federal guidelines also not in compliance. Despite all this the Ordinance faulty language and maps were approved on May 2, 2017 by the Coos County Commission and will go into effect on July 31, 2017.  The changes apply to all unincorporated areas of the Coos County ouside of the Coos Bay Estuary Management Plan and the Coquille River Estuary Management Plan where most of the tsunami and earthquake hazards would occur.  Not applying to these areas greatly benefits the Jordan Cove project which is located in a Coos Bay Estuary Coastal Shoreland.
      1. (EXT-17-002)Pacific Connector CUP Application Expiration and Extension of Conditional Uses for a one year extension of Coos County File No. HBCU-13-04.  On May 17, 2017 Coos County Planning approved an extension request from Pacific Connector under EXT-17-002 to extend the CUP issued under HBCU-13-04 for one year until Feb 25, 2018.  Deadline to appeal was June 1, 2017.
      1. (EXT-17-005Pacific Connector CUP Application Expiration and Extension of Conditional Uses for a one year extension of Coos County File No. HBCU-10-01/REM-11-01?HBCU-13-02.  On May 18, 2017, Coos County Planning approved an extension request from Pacific Connector under EXT-17-005 to extend the CUP issued under HBCU-10-01, Final Order No. 10-01-045PL as amended on remand, File No. REM-11-01, Final Order 12-03-018PL and as modified under HBCU-13-02, Final Order No. 14-01-006PL.  Extension was granted until April 2, 2018.  Deadline to appeal was set for June 2, 2017.

On December 13, 2016, Jordan Cove formally requested a withdrawal of their pending application before the Oregon Energy Facility Siting Council for their 420 megawatt South Dunes Power Plant.

On December 14, 2016, JCEP and PCGP formally requested a withdrawal of their pending Army Corps of Engineers Removal-Fill permit application, NWP-2012-441.

On December 15, 2016, JCEP and PCGP formally requested a withdrawal of their pending DEQ 401 water quality certification application from processing.

On November 10, 2016, the Oregon Dept of State Lands (DSL) extended their removal-fill permit decision for Jordan Cove to August 7, 2017 in order to give Jordan Cove more time to find an alternative pipeline route that does not go up the Haynes Inlet as that route was not found to be acceptable to the DSL.

July 9 – 11th, 2015: The Jordan Cove [Money Laundering? -or-] Community Enhancement Plan work group, South Coast Community Foundation board, and Waterfront Development Partnership work group will travel throughout Coos County July 9-11 to explain each part of the plan.

The town halls will be:

      • 6-8 p.m. July 9 at Blossom Gulch Elementary, Coos Bay
      • 11 a.m.-1 p.m. July 10 at The Barn, Bandon
      • 10 a.m.-noon July 11 at Oaks Pavilion, County Fairgrounds, Myrtle Point

June 2, 2015: 6 – 9 P.M. A Public Hearing was held on the proposed renewal of the Fort Chicago Holdings National Pollution Discharge Elimination System water quality permit. Fort Chicago is the legal owner of the Jordan Cove Energy Project, which proposes to construct a liquefied natural gas export terminal and related project elements in North Bend. (In 2011 Fort Chicago was converted to a Canadian Corporation called Veresen.) Jordan Cove Clean Air Permit 

May 25, 2015: Comment Deadline.  The Department of Environmental Quality reopened the public comment period for the Jordan Cove Energy Project proposed Air Contaminant Discharge Permit.  The Environmental Quality Commission had recently adopted rules that change particulate matter standards, and these new standards were incorporated into the proposed permit, changing Permit Conditions 7, 11, and 12.  These were the only conditions open for additional comment.  The comment period ended at 5:00 p.m. on May 25, 2015.
